This page previously hosted a report regarding an NWT Supreme Court ruling. We’ve withdrawn the reporting to comply with a publication ban.
The decision in question was initially circulated to media. After our reporting was published, the court said an automatic publication ban that should have been declared on the written decision was inadvertently not included.
The type of publication ban in question is known as a section 648 ban after the Criminal Code section that defines it.
Such bans are deployed by the courts to avoid publication of information that might provide a jury with details or arguments they would not otherwise be present to hear in court.
In this instance, a jury had not yet been empanelled and was unlikely to be selected for months. However, in 2023 the Supreme Court of Canada ruled that despite its narrow wording, section 648 applies to some hearings well before a jury is chosen.
Cabin Radio rarely withdraws reporting. This is the first time an article has been withdrawn following publication. We’re doing so in recognition that the original decision should have carried a stated publication ban and withdrawal of the information is in the interest of justice.
